Terms and Conditions

1. Introduction and Acceptance of Terms
By accessing or using the MeMove Pick platform, website or services, users agree to be bound by these Terms and Conditions and the Privacy Policy.
Users who are below 18 years old must obtain consent from their parent or legal guardian before using the Platform and remain responsible for all charges incurred.
MeMove Pick may modify these Terms at any time. Updated Terms will take effect upon posting on the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Singapore.
2. Definitions and Interpretation
“Platform” means the MeMove Pick website, applications and related services.
“User” means any person who uses the Platform to request delivery services.
“Merchant” means any business or seller offering goods for sale.
“Rider” means any person performing delivery services, whether as an employee or independent service provider.
“Delivery Request” means a request made by a user for delivery services through the Platform.
“Purchase on Behalf Service” means a service where MeMove Pick or its riders purchase goods from merchants on behalf of users and deliver such goods.
3. Nature of Service
MeMove Pick provides logistics and delivery services only and, where applicable, acts as a purchasing agent for users under the Purchase on Behalf Service. MeMove Pick is not a seller, reseller, manufacturer or distributor of any goods.
Except for Purchase on Behalf Services, users place and pay for orders directly with merchants. Any contract for the purchase of goods is strictly between the user and the merchant.
MeMove Pick is not a party to any transaction between users and merchants and does not control, endorse or guarantee any goods or services provided by merchants.
4. Merchant Responsibility and Third Party Merchants
Merchants are solely responsible for the preparation, quality, safety, packaging, legality and accuracy of goods sold to users.
MeMove Pick shall not be responsible for incorrect items, missing items, food quality, portion size, food temperature, contamination, allergen content or compliance with dietary requirements.
Users with allergies, medical conditions or specific dietary requirements are responsible for contacting merchants directly before placing orders.
Some merchants may not be partnered with MeMove Pick. MeMove Pick does not guarantee operating hours, order acceptance or preparation times of non partner merchants.
If a merchant is closed, sold out, refuses to prepare an order or is unable to fulfil the order, MeMove Pick shall not be responsible for any losses incurred by the user, including amounts paid to the merchant.
5. User Accounts and Responsibilities
Users must provide accurate and complete contact and address information.
Users are responsible for all activities conducted under their account and must not share account access with others.
MeMove Pick may suspend or terminate accounts for suspected fraud, abuse, misuse or breach of these Terms.
6. Ordering and Delivery Requests
Delivery requests are confirmed when submitted on the Platform and accepted for rider assignment.
Estimated delivery times are not guaranteed and may vary due to traffic, weather, merchant preparation time, rider availability and multi store routing.
Users are responsible for ensuring that merchants are ready for pickup at the time of the delivery request.
7. Fees and Payments
7.1 Separation of Goods Payment and Delivery Fees
For standard pickup deliveries, payment for goods is made directly to merchants and is not collected by MeMove Pick.
Delivery fees are payable to MeMove Pick and are separate from merchant payments.
7.2 Dynamic Pricing of Delivery Fees
Delivery fees are calculated dynamically and may vary based on distance, number of pickup locations, time of day, rider availability, traffic, weather and operational demand and supply.
The applicable fee is displayed before confirmation. By confirming, users agree to the final displayed fee.
7.3 Multi Store and Additional Pickup Fees
Additional fees may apply for each additional pickup location. The total fee will be displayed before confirmation.
Users acknowledge that multi store deliveries may result in longer delivery times and possible food quality degradation, for which MeMove Pick is not responsible.
7.4 Payment Methods
Payment must be completed using available payment methods before a delivery request is accepted unless otherwise stated.
7.5 Cancellation and Refunds
Users may cancel only before a rider is assigned. Once a rider is assigned, delivery fees are fully chargeable and non refundable.
If cancelled after pickup has started or rider has arrived, no refund shall be provided.
MeMove Pick does not refund amounts paid to merchants except where expressly stated under Purchase on Behalf Services and subject to merchant refund policies.
7.6 Failed Pickup or Delivery
Delivery fees remain chargeable if failure occurs due to incorrect details, merchant unavailability, recipient unreachability or access issues.
7.7 Pricing Errors
In case of system or pricing errors, MeMove Pick may cancel or adjust fees prior to delivery and refund delivery fees where applicable.
7.8 Promotions and Vouchers
Promotions and vouchers may be modified or withdrawn at any time and are not exchangeable for cash.
7.9 Taxes
Delivery fees may be inclusive or exclusive of GST depending on applicable law. Users are responsible for taxes payable to merchants.
8. Purchase on Behalf Service (Buy and Deliver)
Where expressly offered on the Platform, MeMove Pick or its riders may purchase goods from merchants on behalf of users and deliver such goods.
Prices displayed are estimates and may differ from actual merchant prices. Users authorise MeMove Pick to pay actual prices on their behalf, subject to any stated spending limits.
If items are unavailable, reasonable substitutions of equal or lower value may be made where permitted. Where substitution is not possible, unavailable items may be omitted.
Refunds for goods are subject to merchant refund policies. MeMove Pick does not guarantee refunds and is not responsible for merchant refusal to refund.
Delivery fees remain non refundable once a rider is assigned regardless of refund status of goods.
Users must report issues within a reasonable time with supporting evidence. MeMove Pick may assist in contacting merchants but does not guarantee resolution.
9. Delivery Process and Proof of Delivery
Delivery services are provided on a best efforts basis.
Riders may wait for a reasonable period at pickup or delivery locations. If merchants or recipients are unavailable, delivery shall be deemed attempted.
If locations are inaccessible or unsafe, delivery may be terminated and deemed attempted.
Proof of delivery may include GPS logs, timestamps, photographs or electronic acknowledgements.
Delivery is completed when goods are delivered to the specified location regardless of personal receipt.
MeMove Pick is not responsible for loss, theft or damage after delivery completion.
Undeliverable items may be disposed of or returned at MeMove Pick’s discretion.
10. Prohibited Items and Right to Refuse Delivery
Users must not request delivery of illegal, unsafe or restricted items.
Prohibited items include illegal drugs, weapons, hazardous materials, stolen goods, leaking items, controlled items requiring permits and high value documents unless approved.
MeMove Pick does not provide temperature controlled transport unless stated.
Delivery of medicines is subject to applicable laws and users are responsible for compliance.
Riders and MeMove Pick may refuse or terminate delivery if items are unsafe, unlawful, misrepresented, poorly packaged or delivery circumstances are unsafe or abusive.
Delivery fees remain chargeable once rider is assigned.
Users must cooperate with regulatory investigations where required.
Users indemnify MeMove Pick against claims arising from prohibited or unlawful delivery requests.
11. Rider Status and Liability
Delivery services may be performed by riders who are employees or independent service providers.
Riders do not have authority to bind MeMove Pick unless authorised in writing.
Users shall not manage or direct riders beyond reasonable delivery information.
MeMove Pick is not responsible for rider conduct except where liability cannot be excluded by law.
MeMove Pick may provide insurance where required by law but does not guarantee coverage for all risks.
12. Limitation of Liability
The Platform is provided as is without warranties of uninterrupted service.
MeMove Pick shall not be liable for indirect or consequential losses.
Where liability cannot be excluded, liability shall be limited to the delivery fee paid for the affected delivery request.
13. Indemnity
Users agree to indemnify MeMove Pick against all claims, losses, damages and penalties arising from breaches of these Terms, unlawful delivery requests or misuse of the Platform.
14. Intellectual Property
All content, branding and software on the Platform are owned by MeMove Pick or its licensors and may not be used without permission.
15. Data Protection and Privacy
Personal data is processed in accordance with the Privacy Policy. Users consent to data processing for delivery services.
16. Promotions and Special Programs
Separate terms may apply to promotions or campaigns. MeMove Pick may modify or withdraw programs at any time.
17. Suspension and Termination
MeMove Pick may suspend or terminate access for breaches, fraud, abuse or operational reasons.
Service availability is not guaranteed.
18. Dispute Resolution
Users should first contact customer support for disputes. Courts of Singapore shall have jurisdiction.
19. General Provisions
If any provision is invalid, remaining provisions remain enforceable.
Failure to enforce any provision does not constitute waiver.
These Terms constitute the entire agreement between users and MeMove Pick regarding use of the Platform.
